1. Terms
Tiger Youth Soccer, LLC. Tiger Youth Soccer, LLC (Tiger Youth Soccer) is a Washington State Limited Liability Company that’s runs and operates soccer programs for children 18 years of age and under. Tiger Youth Soccer refers to the company that oversees putting on the program(s) for the Participant.
Participant. The Participant refers to the child/children that are enrolled and/or participate in programs/events held by Tiger Youth Soccer.
Parent and/or Legal Guardian. This is the natural biological mother or father of the child, the legally adopted parent(s) and/or a person recognized by the law as the child’s mother or father, even if not biological.
The Parent and/or Legal Guardian has authority to make decisions on behalf of the child.
2. Liability Release and Parental Consent Form
In consideration of, and as a precondition for Participant being allowed to participate with Tiger Youth Soccer, the Participant and Parent and/or Guardian understand, acknowledge and agree as follows:
Except with respect to an injury or loss that occurs on public lands whose rules and regulations may prohibit our doing so, we release and discharge Tiger Youth Soccer from any and all responsibility, claims, liability, actions and causes of action for, on account of, or in any way directly or indirectly arising out of any and all known or unknown loss or damage arising from or in any way connected with the Participant’s enrollment or participation. This release includes but is not limited to loss or damage caused by the negligence of Tiger Youth Soccer but does not include loss or damage caused by gross negligence, or by reckless, willful or wanton misconduct on the part of Tiger Youth Soccer. We understand that in signing this document we surrender our right to make a claim or file a lawsuit against Tiger Youth Soccer for personal injury or property damage, wrongful death or otherwise, except in cases of gross negligence, or reckless, willful or wanton misconduct.
Parent(s)/Legal Guardian agrees to indemnify (that is, protect by payment or reimbursement) Tiger Youth Soccer (i) from any claim which may be brought by or on behalf of the Participant, or by any member of the Participant’s family, for injury or loss arising from or in any way connected with Participant’s enrollment or participation in the Program except injury or loss caused by gross negligence, or by reckless, willful or wanton misconduct on the part of Tiger Youth Soccer and (ii) from any claim which may be brought by any third party for injury or loss resulting from our (as defined above) acts or omissions.
This release is intended to discharge in advance, Tiger Youth Soccer’s employees, independent contractors, volunteers and/or agents from liability, even though liability may arise out of perceived negligence on the part of persons mentioned above.
We agree that this document, and every other aspect of our relationship with Tiger Youth Soccer, contractual or otherwise, is governed by the laws of the State of Washington. Further, any suit, mediation or arbitration arising out of or relating to Tiger Youth Soccer, or any other dispute with Tiger Youth Soccer, must be filed or entered only in the Superior Court of King County, Washington.
If any portion of this agreement or the application thereof to any circumstances is found by a court or other appropriate authority to be unenforceable or invalid, the remainder or other application of this agreement nevertheless will remain in full force and effect.
3. Arbitration
In lieu of any lawsuit regarding a legal dispute, any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association or a similar organization agreed upon by the parties, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
The jurisdiction is Washington state and venue in King County, Washington.
4. Consent for Treatment
In the event of a physical injury, Participant’s Parent and/or Legal Guardian give Tiger Youth Soccer consent to medical treatment which may include emergency medical personnel, staff members, a physician or surgeon. Participant’s Parent and/or Guardian acknowledges and agrees that any medical treatment rendered by medical personnel may be subject to monetary expense for which Parent or Guardian may be responsible.
WE HAVE READ, UNDERSTAND AND ACCEPT THE TERMS AND CONDITIONS stated herein and acknowledge that this agreement shall be effective and binding upon us, our heirs, assigns, personal representative and estate and all members of our family, both before and after the minor Participant reaches majority.
